How Long Until I Get My Settlement Check?

Once the stress is behind you, the waiting becomes its own frustration. Here’s an honest timeline — both for reaching a settlement and for the check actually landing after you say yes.

Plain-English answers to the questions crash victims actually ask.

First, reaching a settlement

What controls the clock

The single biggest factor is maximum medical improvement — a settlement should include every future cost, which can't be known until your condition stabilizes. Disputed fault, claim size, and litigation all add time. Insurers know your state's lawsuit deadline and sometimes slow-walk toward it.

After you agree, the check still takes weeks

Saying "yes" isn't the end. Typically: you sign a release; the insurer issues the check (often to you and your attorney jointly); it's deposited into the attorney's trust account and must clear; then liens and bills — health insurer reimbursement, medical liens, case costs, and the attorney fee — are paid out; and finally your net amount is disbursed. This back end commonly runs a few weeks.

How to avoid extra delay

Complete treatment without gaps, return signed paperwork promptly, and make sure outstanding medical bills and liens are identified early so they don't surface at the last step.

Don't trade value for speed: the fastest settlement is almost always the discounted one. Once you sign the release, the claim is closed for good.
